Andy Whitfield, the Welsh actor best known for his portrayal of the eponymous hero in Spartacus : Blood and Sand has died aged 39 after a long battle with cancer. Andy was born in Amlwch but moved to Sydney in the late nineties where he switched from engineering to modeling and acting. He started out as a model in commercials, runways and print ads in various magazines and catalogs. His initial reaction to modeling was not so optimistic, instead his aspiration was to be an actor. After a period of struggle, he finally landed his first acting role at age 30 in the TV series All Saints. And has since appeared in several Australian television series, such as Opening Up, The Strip, Packed to the Rafters and McLeod's Daughters. However, Andy got his big break in the film Gabriel in which he played the lead role - Since the beginning of time, Heaven and Hell have fought over purgatory and the souls trapped inside it. Each side has sent seven warriors: Archangels from heaven, Fallen Angels from hell. Hell has attained control, transforming purgatory into a dark, seedy city. The last Archangel, Gabriel endeavours to discover what has become of his comrades and to restore the Light. But it is as the warrior we love so much in Spartacius : Blood and Sand that he will be remembered. The high drama, vibrant sexuality, and strength of story led Spartacus to become an instant hit. Andy was then known across the world for his sensitive and strong portrayal of the Thracian slave who leads his fellow gladiators to overthrow their Linister and escape to freedom. At the end of Blood and Sand it was announced that a prequel, Gods of the Arena, would be shot to allow Andy to recover from non-Hodgkin lymphoma. However it became clear that he would not be well enough to reprise the role of Spartacus in the third season, Vengeance. I think Andy was a beautiful man and an amazing actor. He had an allure about him that could not be ignored. I fell in love with him the first time I watched Gabriel, and that attraction only grew when I discovered Spartacus. It's always a shame to lose someone so young and talented, and he will be missed by his huge worldwide fanbase - myself included. I would like to take this time to send my deepest sympath to his family. Andy is survived by his wife Vashti and their two children.

The death of most sought after terrorist in the world Osama Bin Laden was announced on the same date as the death of Nazi leader Adolf Hitler.

Hitler's death was announced to the public on May 1st, after he supposedly took his own life on April 30th, 1945. Hither's body was never recovered (the body believed to be Hitler's was exhumed by the Russians, it turned out to be the body of a female in her 20's.)

Bin Laden's death was also announced on May 1st. His body has still not been seen.

Under President Pervez Musharraf ~ the Taliban were about to take an easy stroll onto Islamabad. One wonders if the world did not apply pressure on him to act ~ would these holy warriors been greeted with fresh cut flowers, as they had already reached 60 miles outside of the capital, in the end virtually unopposed by Pak military.

But there is growing talk about the money, as before the large international handouts to defeat this Taliban-terrorist-enemy ~ Musharraf was saying we already have Shari'a law anyway. And that there was no significant threat to the country. When he saw the money, it was ~ we are going to be taken over!! And the around the world tour began.

It is true that a large amount of Pakistani soldiers have died, but what also appears true that if no international pressure is applied, little or no effort would be made. The idea being if you stamp things out early, then there would not be the huge problem of Taliban taking complete control of whole regions ~ later!

Obviously they have a relationship with their hardliners that goes beyond waging war against India. It must be as some Pakistani officials/politicians have said, that this is an extension of their religion.

Former Pakistani President Pervez Musharraf on Monday accused the U.S. of violating his country’s sovereignty by sending in special forces to kill Osama bin Laden.

“American troops coming across the border and taking action in one of our towns, that is Abbottabad, is not acceptable to the people of Pakistan. It is a violation of our sovereignty,” Mr. Musharraf told CNN-IBN, an Indian news channel.

He added that it would have been “far better if Pakistani Special Services Group had operated and conducted the mission. To that extent, the modality of handling it and executing the operation is not correct.”

Bin Laden was killed Sunday in a firefight with Navy SEALs in a million-dollar, fortified compound located in an affluent neighborhood in Abbottabad, about a two-hour drive from Pakistan’s capital, Islamabad.

Senior U.S. officials, who briefed reporters early Monday, said the Obama administration did not inform Pakistani authorities of the mission until after it was concluded.

Mr. Musharraf said the “lack of trust is very bad.”

“If two organizations [are] conducting an operation against a common enemy, there has to be trust and confidence in each other,” he said.

Pakistan is “totally on board” on fighting al Qaeda and Taliban.

Mr. Musharraf said it was possible that some local Pakistanis had colluded with bin Laden.

“A battle has been won, but the war continues,” Mr. Musharraf said, warning that “al Qaeda is still there.”

Intelligence gathered from detainees at Guantanamo Bay may also have made the Americans wary of sharing their operational plans with the Pakistani government.

The Pakistanis supported the Taliban even as they were shooting women in the head, for reading a book or what other ludicrous crimes a women could now commit in this new Islamic state of Afghanistan. Clearly the Pakistanis, both then as now, were lured by the attraction of the puritanical Islamic state. Hiding Bin Laden, was likely one of the ways of expressing this.

The coincidences are mounting up for Pakistan ~ remember the Red Mosque ~ teenage girls, ready for martyrdom, sent out onto Islamabad streets with sticks, to enforce Islamic law. It was only after these burqa-ed babes took a Chinese national hostage, and an international incident developed that something was done to bring the mosque and its schools under control. Inside of the mosque there was every type of weapon, from grenades to anti-tank mines ~ was also strangely situated opposite the ministry of defence building in Islamabad.

American diplomats were told that one of the key reasons why they had failed to find bin Laden was that Pakistan’s security services tipped him off whenever US troops approached.

Pakistan’s Inter-Services Intelligence Directorate (ISID) also allegedly smuggled al-Qaeda terrorists through airport security to help them avoid capture and sent a unit into Afghanistan to fight alongside the Taliban.

The claims, made in leaked US government files obtained by Wikileaks, will add to questions over Pakistan’s capacity to fight al-Qaeda.

Last year, David Cameron caused a diplomatic furore when he told Pakistan that it could not “look both ways” on terrorism. The Pakistani government issued a strongly-worded rebuttal.

But bin Laden was eventually tracked down and killed in compound located just a few hundred yards from Pakistan’s prestigious military academy in Abbotabad.

The raid by elite US troops was kept secret from the government of Pakistan. Only a tight circle within the Obama Administration knew of the operation.

In December 2009, the government of Tajikistan warned the United States that efforts to catch bin Laden were being thwarted by corrupt Pakistani spies.

According to a US diplomatic dispatch, General Abdullo Sadulloevich Nazarov, a senior Tajik counterterrorism official, told the Americans that “many” inside Pakistan knew where bin Laden was.

The document stated: “In Pakistan, Osama Bin Laden wasn’t an invisible man, and many knew his whereabouts in North Waziristan, but whenever security forces attempted a raid on his hideouts, the enemy received warning of their approach from sources in the security forces.”

One detainee, Saber Lal Melma, an Afghan whom the US described as a probable facilitator for al-Qaeda, allegedly worked with the ISID to help members flee Afghanistan after the American bombing began in October 2001.

His US military Guantanamo Bay detainee file, obtained by Wikileaks and seen by The Daily Telegraph, claims he allegedly passed the al-Qaeda Arabs to Pakistani security forces who then smuggled them across the border into Pakistan.

He was also overheard “bragging about a time when the ISID sent a military unit into Afghanistan, posing as civilians to fight along side the Taliban against US forces”.

He also allegedly detailed “ISID's protection of Al-Qaida members at Pakistan airports. The ISID members diverted Al-Qaida members through unofficial channels to avoid detection from officials in search of terrorists,” the file claims.

Pakistan harbored Osama bin Laden for 6 years

Now that the news of Osama bin Laden's death is starting to get stale, it will certainly be fascinating in the next week or two to watch how the Pakistani government squirms out of this one: it is apparent to absolutely anyone with half a brain that the compound in Abbottabad, Pakistan where Osama bin Laden lived since it was constructed in 2005 was at least in part built, funded, maintained and secured by the Pakistani government.

No other conclusion can be drawn.

This facility was within 100 yards of Pakistan's version of West Point. It was ten times the size of all of the other structures within this community, and had the security of Fort Knox. Most of the neighbors were aware that a person of significant stature lived within these 18 foot walls for the past six years, and to think that the Pakistani government was completely unaware of its inhabitant's identification really stretches their credibility when they deny knowledge of the whereabouts of Osama bin Laden.

If you recall, the Bush Doctrine defined our enemies after 9/11 as those who committed the atrocities of that terrible day, and that we would not distinguish between these foul enemies and those who harbored them. The Pakistani government, to include former president Perves Musharref, and current president Asif Ali Zardari were complicit in the harboring of Osama bin Laden for six long years.

Now we know on which side of the fence Pakistan's loyalty lies: with the terrorists. Pakistan should now be cut off immediately from U.S. foreign aid, no trade between the U.S. and Pakistan should be allowed, and no travel by U.S. citizens to this enemy state should be authorized by the Department of State. This is the law of the land, and President Obama should follow through with this logical process.

Pakistan is a nuclear armed rogue state, and the danger it poses to the U.S. and its interests as well as world stability are enormous. The proof of this is sitting right in front of all of our noses: Pakistan is not our friend.

NEW DELHI —(AFP) India on Monday used the death of Osama bin Laden to denounce rival Pakistan as a terrorist "sanctuary," as it renewed calls for Islamabad to arrest suspects behind the 2008 Mumbai attacks.

Home Minister P. Chidambaram said India noted with "grave concern" that bin Laden had been found hiding in a palatial villa less than two hours' drive from the Pakistani capital Islamabad.

"This fact underlines our concern that terrorists belonging to different organisations find sanctuary in Pakistan," Chidambaram said as Indian Prime Minister Manmohan Singh urged Islamabad to take action against militants.

"The international community and Pakistan in particular must work comprehensively to end the activities of all such groups who threaten civilised behaviour and kill innocent men, women and children," Singh said.

The premier said he hoped bin Laden's killing would deal a "decisive blow to Al-Qaeda and other terrorist groups."

India accuses Pakistan of providing shelter and support to militant groups planning attacks on Indian soil and has repeatedly pushed the global community -- the United States in particular -- to censure Pakistan accordingly.

US President Barack Obama said the operation to kill bin Laden was the result of cooperation with Pakistan, but US officials admitted that they had not informed Islamabad before the strike by US forces.

Home Minister Chidambaram focused on India's belief that perpetrators of the 2008 Mumbai attacks continue to be sheltered in Pakistan.

"We once again call upon the government of Pakistan to arrest the persons whose names have been handed over," he said.

India says the 10 gunmen who attacked multiple targets in Mumbai, killing 166 people, were members of the Pakistan-based Lashkar-e-Taiba militant group.

India suspended peace talks with its long-time South Asian rival after the attacks.

That dialogue was recently resumed, but India has continued to criticise Pakistan for not doing enough to bring the organisers to justice.

Nuclear-armed India and Pakistan have fought three wars since attaining their independence in 1947, two over the disputed territory of Kashmir.

In a separate statement, Indian Foreign Minister S.M. Krishna said the US success in killing bin Laden was an "historic development and victorious milestone" in the global war on terror.

But, in another clear reference to Pakistan, he also stressed the need to root out militant safe havens in South Asia.

"The world must not let down its united effort to overcome terrorism and eliminate the safe havens and sanctuaries that have been provided to terrorists in our own neighbourhood," he said.

The same message was hammered home by Defence Minister A.K. Antony, who said Pakistan had a long history of denying evidence that it was aiding and abetting militant groups.

"This incident establishes that Pakistan has been sheltering terrorists and now the country must take steps against them," he told reporters after visiting a military post in the desert region of Jaisalmer bordering Pakistan.

Lalit Mansingh, a former ambassador to the United States, said he believed Obama's mention of Pakistani cooperation was aimed at deflecting any criticism that the US special operation may have infringed Pakistani sovereignty.

"The fact is that Pakistan is going to have to answer some uncomfortable questions arising from this, not least of which is how bin Laden was able to hide so close to Islamabad for so long," Mansingh told AFP.

"One suspects he must have had some help from figures in the Pakistani establishment," he added.

Terming the elimination of Osama bin Laden as a confirmation that Pakistan remains the “epicentre of global terror”, the Bharatiya Janata Party on Monday said India must ensure that those responsible for the 26/11 terrorist attacks must be handed over to it.

While Leader of the Opposition in the Lok Sabha, Sushma Swaraj, in her tweet called bin Laden “humanity’s enemy number one”, BJP spokesperson Ravi Shankar Prasad said he (Laden) was the most visible and dangerous face of global jihadi terror.

“We demand that all the terrorists responsible for terror attacks from across the border must be handed over to India.

It is a litmus test for Pakistan. Government of India must acknowledge this fact in all future talks with Pakistan,” Mr. Prasad said.

Abbottabad, a place where Osama bin Laden was killed

I met Osama bin Laden in early 1996 in Laghman province in Afghanistan.

This tall, and quite handsome man seemed a serious and likeable man. As is the Afghan tradition, when a foreigner is in an area, he called me over to his table in a small, dirty tea shop to join him for tea. He asked me what I had been doing and I told him that I had been into the mountains of Nuristan with my Afghan Red Crescent colleagues where we were building a clinic, two days walk from the road. I said women die in child birth because they don't even have basic facilities and now we have trained doctor and nurse. He congratulated us. I didn't know much about this man, but he left an impression on me. Little was I to know his future doings.

But some years later I got to know more about this man.

I'm hurting today because it seems Ahmed Shah Massoud is either dead or dying. Some say it could be the work of Osama bin Laden. I think of the times we met during my stay in Afghanistan between 93 and 96, and the hour interview I had with him before I left in August 1996. My friend Azem was killed too and Massood Khalili badly injured, the Ambassador to India and son of the great Afghan poet.

In my diary that night I wrote in capitals A DAY WHICH MAY CHANGE THE BFACE OF THE EARTH AND THE NATURE OF TERRORISM.

The scenarios began tio build up in my mind; retaliations on Afghanistan yet again. Alexander the Great, Arabs, The Turks, Chengis Khan, Timur, Persians, The British x 3, Soviet Union and now a US led western coalition.

Today Osama bin Laden was killed in Abbottabad, which I recall after many visits beween 1994 and 2006, as a peaceful place, named after home to at least one regiment of the Pakistani army, is dotted with military buildings and home to thousands of army personnel. Surrounded by hills and with mountains in the distance, it is less than half a day's drive from the border region with Afghanistan.

Where did the name Abbottabad come from?

Although, Abbottabad today is a thriving business and tourism city, it is traditionally a military city. Besides the prestigious Pakistan Military Academy (PMA) in a nearby village of Kakul, Abbottabad is home to three regimental centres of Pakistan Army and Army School of Music. The PMA provided fame to Abbottabad for many years, prior to the recent development of the city, from a non-industrial backward area, to a busy modern business, economic and academic centre. The city takes it roots from the British India, when Major James Abbott came this way in 1853 after the annexation of Punjab into the British dominion and laid the foundation of a military cantonment. He also became the first Deputy Commissioner of Hazara Division. By 1901 the population of the town and cantonment had grown to around 7,764, which today stands at 300,000. Abbottabad remained the dominating district till 1976, when one of its tehsils Mansehra was given the status of district, which now consist of Mansehra and Batagram Tehsils. Subsequently in July 1991, Haripur Tehsil was separated from Abbottabad and made district. Thus only the Tehsil Abbottabad remained, which was declared as district. Major Abbott was so mesmerized by the beauty of the area that when leaving Abbottabad with a nostalgia a, he wrote a poem expressing his love and affection for the place he founded.

The prime minister of the Gaza Strip government calls the Al Qaeda terrorist leader a "holy warrior."

Ismail Haniyeh, prime minister of the Hamas government in the Gaza Strip, on Monday denounced the U.S. killing of Al Qaeda chief Osama bin Laden in Pakistan.

"We condemn the assassination and the killing of an Arab holy warrior," Haniyeh told reporters, according to Reuters. "We regard this as a continuation of the American policy based on oppression and the shedding of Muslim and Arab blood."

His words were likely to do nothing for the reputation of the Islamist party, which popularized suicide bombings against Israel and is considered a terrorist organization by the United States and the European Union. Ironically, Hamas has battled more radical Islamic groups in the Gaza Strip in recent years.

For its part, Hamas' chief rival, the Palestinian Authority, which rules the West Bank, hailed Bin Laden's death.

"Getting rid of Bin Laden is good for the cause of peace worldwide, but what counts is to overcome the discourse and the methods -- the violent methods -- that were created and encouraged by Bin Laden and others in the world," Palestinian Authority spokesman Ghassan Khatib said, according to Reuters.

(Reuters) - U.S. forces finally found al Qaeda leader Osama bin Laden not in a mountain cave on Afghanistan's border, but with his youngest wife in a million-dollar compound in a summer resort just over an hour's drive from Pakistan's capital, U.S. officials said.

A small U.S. team conducted a night-time helicopter raid on the compound early on Monday. After 40 minutes of fighting, bin Laden and an adult son, one unidentified woman and two men were dead, the officials said.

U.S. forces were led to the fortress-like three-story building after more than four years tracking one of bin Laden's most trusted couriers, whom U.S. officials said was identified by men captured after the Sept. 11, 2001 attacks.

Pak security kept in dark over secret operation
to capture or kill Bin Laden.

"Detainees also identified this man as one of the few al Qaeda couriers trusted by bin Laden. They indicated he might be living with or protected by bin Laden," a senior administration official said in a briefing for reporters.

Bin Laden was finally found -- more than 9-1/2 years after the 2001 attacks on the United States -- after authorities discovered in August 2010 that the courier lived with his brother and their families in an unusual and extremely high-security building, officials said.

They said the courier and his brother were among those killed in the raid.

"When we saw the compound where the brothers lived, we were shocked by what we saw: an extraordinarily unique compound," a senior administration official said.

"The bottom line of our collection and our analysis was that we had high confidence that the compound harboured a high-value terrorist target. The experts who worked this issue for years assessed that there was a strong probability that the terrorist who was hiding there was Osama bin Laden," another administration official said.

The home is in Abbottabad, a town about 35 miles (60 km) north of Islamabad, that is relatively affluent and home to many retired members of Pakistan's military.

It was a far cry from the popular notion of bin Laden hiding in some mountain cave on the rugged and inaccessible Afghan-Pakistan border -- an image often evoked by officials up to and including former President George W. Bush.

The building, about eight times the size of other nearby houses, sat on a large plot of land that was relatively secluded when it was built in 2005. When it was constructed, it was on the outskirts of Abbottabad's centre, at the end of a dirt road, but some other homes have been built nearby in the six years since it went up, officials said.

WALLS TOPPED WITH BARBED WIRE

Intense security measures included 12- to 18-foot (3.6 meters to 5.5 meters) outer walls topped with barbed wire and internal walls that sectioned off different parts of the compound, officials said. Two security gates restricted access, and residents burned their trash, rather than leaving it for collection as did their neighbours, officials said.

Few windows of the three-story home faced the outside of the compound, and a terrace had a seven-foot (2.1 meter) privacy wall, officials said.

"It is also noteworthy that the property is valued at approximately $1 million but has no telephone or Internet service connected to it," an administration official said. "The brothers had no explainable source of wealth."

U.S. analysts realized that a third family lived there in addition to the two brothers, and the age and makeup of the third family matched those of the relatives -- including his youngest wife -- they believed would be living with bin Laden.

"Everything we saw, the extremely elaborate operational security, the brothers' background and their behaviour and the location of the compound itself was perfectly consistent with what our experts expected bin Laden's hide-out to look like," another Obama administration official said.

Abbottabad is a popular summer resort, located in a valley surrounded by green hills near Pakistani Kashmir. Islamist militants, particularly those fighting in Indian-controlled Kashmir, used to have training camps near the town.

We don't know yet who will head up the Al Qaeda network ~ but if Zawahri were to gain control ~ the roots would run deep in the Egyptian psyche. He is the grandson of a grand Imam of the Al Alzhar mosque ~ and he also once had ties with the Muslim Brotherhood, indeed Al Qaeda's theories spring from the same ideology. This at a time when the Egyptian state finds itself on a balance, which could mean that it tips towards the radical side ~ more than the other.

(Reuters) - Egyptian-born doctor and surgeon Ayman al-Zawahri is al Qaeda's second-in-command expected to succeed Osama bin Laden following his killing in a firefight with U.S.forces in Pakistan.

Zawahri has been the brains behind bin Laden and his al Qaeda network, and at times its most public face, repeatedly denouncing the United States and its allies in video messages.

In the latest monitored by the SITE Intelligence Group last month, he urged Muslims to fight NATO and American forces in Libya.

"I want to direct the attention of our Muslim brothers in Libya, Tunisia, Algeria, and the rest of the Muslim countries, that if the Americans and the NATO forces enter Libya then their neighbours in Egypt and Tunisia and Algeria and the rest of the Muslim countries should rise up and fight both the mercenaries of Gaddafi and the rest of NATO," Zawahri said.

Born into an upper-class family of scholars and doctors in an upscale Cairo neighbourhood, the cerebral Egyptian in his late-50s is second after bin Laden on the FBI "most wanted terrorists" list.

Both bin laden and Zawahiri eluded capture when U.S.-led forces toppled Afghanistan's Taliban government in late 2001 after al Qaeda's Sept. 11 attacks on U.S. cities.

But on Sunday bin Laden was killed in a firefight with U.S. forces and his body was recovered, U.S. President Barack Obama said. There was no word on Zawahri.

Bespectacled, with grey hair and a grey beard, Zawahri won prominence in Nov. 2008, when he attacked then U.S. President-elect Obama as a "house Negro," a racially-charged term used by 1960s black American Muslim leader Malcolm X to describe black slaves loyal to white masters.

In a subsequent video, in Sept. 2009, Zawahri returned to the attack on Obama, saying he was no different from his predecessor George W. Bush.

"America has come with a new deceptive face ... It plants the same dagger as Bush and his predecessors did. Obama has resorted to the policies of his predecessors in lying and selling illusions," said Zawahri, clad in white robe and turban.

Like bin Laden, Zawahri has long been thought to be hiding along the rugged Afghan-Pakistan border. The last video of Zawahri and bin Laden together was broadcast by al Jazeera on Sept. 10, 2003. It showed them walking in mountains, calling for jihad and praising the Sept. 11 hijackers.

"BRAIN TO THE BODY"

Analysts have described Zawahri as al Qaeda's chief organiser and bin Laden's closest mentor. "Ayman is for bin Laden like the brain to the body," said Montasser al-Zayat, a lawyer in Cairo who once represented Zawahri.

In a video after the Sept. 11 attacks, Zawahri called them a "great victory" achieved "thanks to God".

He has not always been so ebullient.

As U.S.-led forces drove out the Taliban in 2001, Afghan sources described him flying into a fury at the nonchalance of Taliban fighters playing badminton behind the front lines while U.S. bombs rained from the skies.

Zawahri and bin Laden met in the mid-1980s when both were in the Pakistani city of Peshawar to support guerrillas fighting the Soviets in Afghanistan, and worked closely thereafter. But the alliance was not Zawahri's first foray into militancy.

When the militant Egyptian Islamic Jihad was founded in 1973, he joined. When members posed as soldiers and assassinated President Anwar Sadat in 1981, he was among 301 people arrested

He went on trial but was cleared. He did, though, spend three years in jail for having an unlicensed pistol. On his release, Zawahri made his way to Pakistan where he worked with the Red Crescent treating fighters wounded in the Afghan war.

Taking over the leadership of Jihad in Egypt in 1993, he was a key figure in a campaign in the mid-1990s to set up a purist Islamic state there, in which more than 1,200 Egyptians died.

In 1999, an Egyptian military court sentenced Zawahri to death in absentia. He has also been indicted in connection with the 1998 bombings of U.S. embassies in Kenya and Tanzania.

Days after those bombings, he telephoned a Pakistani reporter, denying responsibility, but urging Muslims to "continue their jihad against the Americans and Jews".

An hour later, U.S. cruise missiles hit al Qaeda's Afghan training camps. Both bin Laden and Zawahri escaped injury.

Zawahri's wife, Azza, and three daughters were reported killed in a bombing strike on the Afghan city of Kandahar, the stronghold of the Taliban, in early December 2001.

Zawahri has appeared regularly in a series of video or audio messages since then, criticising the U.S. war in Iraq, praising the Taliban and the suicide bombers who attack London in 2005 and urging Muslims to help victims of an earthquake in Pakistan.

He has occasionally shown he is aware of criticisms by Muslims who dislike the group's indiscriminate violence.

"SEIZE A STATE"

In a 2005 letter to Iraq al Qaeda leader Abu Musab al-Zarqawi, Zawahri suggested it was time to end beheadings of captives and start acting as more of a political leader in anticipation of the eventual U.S. withdrawal from Iraq.

In 2008, Zawahri held an unprecedented question and answer session online with al Qaeda sympathisers who repeatedly questioned him over the group's killings of civilians in Iraq.

Near-silence from Gulf Arabs on Osama bin Laden death

(Reuters) - The death of al Qaeda leader Osama bin Laden was greeted with near-silence on Monday from Gulf Arab states, including his birthplace Saudi Arabia.

By mid-afternoon, the only official comment from the Arabian Peninsula came from Yemen, bin Laden's ancestral homeland, where an official speaking on condition of anonymity hoped the killing would "root out terrorism throughout the world".

Saudi Arabia's official news agency merely noted that the United States and Pakistan had announced bin Laden had been killed in a U.S. military operation in Pakistan but gave no clue to Riyadh's thinking.

The foreign ministers of Bahrain, Kuwait and the United Arab Emirates, attending a meeting of Gulf foreign ministers in the UAE capital Abu Dhabi, all declined to comment on bin Laden's death.

Always anxious about how the small guys cope in battles against the big guys which, in his opinion, should never be fought, tytoc collie was delighted to see the recent ruling in Virgin Enterprises Ltd v Casey [2011] EWHC 1036 (Ch), a ruling of Mr Justice Norris in the Chancery Division, England and Wales, on what the Kat has long considered the totally unmeritorious opposition lodged by Virgin Enterprises to an innocent and non-threatening trade mark application by a small business.

In short, Michael Casey applied to register the word mark CARBON VIRGIN in May 2008 for "advertising; electronic data storage; advertising services provided via the internet; production of television and radio advertisements; accountancy; auctioneering; trade fairs; opinion polling; data processing" in Class 35. Virgin Enterprises opposed the registration, asserting that (i) the mark was identical to its own registered mark VIRGIN which was registered for similar services, (ii) the mark was similar to its marks VIRGIN and VIRGIN GREEN FUND and its 'Virgin' signature mark which were registered for similar services and that there was a likelihood of confusion; (iii) the mark was identical or similar to 13 specific marks registered by Virgin Enterprises which had a reputation of which Casey's mark took unfair advantage and (iv) the term VIRGIN and the 'Virgin' signature were earlier unregistered rights which entitled Virgin Enterprises to block Casey's registration.

The hearing officer rejected all the grounds of opposition and Virgin Enterprises appealed. While it accepted the hearing officer's findings and holdings in respect of grounds (i) and (iv), it argued that the hearing officer had blundered in grounds (ii) and (iii), making no fewer than six errors of law:

(i) the hearing officer had treated the mark VIRGIN as being capable of only one conceptual meaning when used alone, and of having that meaning irrespective of context;

(ii) the hearing officer had determined the conceptual meaning of the marks without reference to the services for which they were registered;

(iii) the hearing officer should not have treated conceptual similarity as being the determinative factor when comparing the marks -- or should at least have explained why he did so;

(iv) the hearing officer, concluding that there was no likelihood of direct confusion, appeared to say that there could only be direct confusion where the marks were identical;

(v) the hearing officer's approach to the level of conceptual similarity was inappropriate within the context of the unfair advantage opposition;

(vi) the hearing officer had misapprehended the nature of the link in that, in the case of unfair advantage, the consumer had to make an economic link to the owner of the earlier mark, whereas the true link that had to be made was by calling the earlier mark to mind.

Norris J dismissed Virgin's appeal. In his view:

When comparing the parties' marks, the hearing officer had chosen the Virgin Enterprise mark closest to Casey's mark and, having referred to a whole range of materials, agreed that there was a reasonable level of visual and aural similarity. However, in respect of conceptual similarity, the hearing officer found that the word VIRGIN had had a subtly different meaning in each mark, resulting in different concepts being created in the mind of the average consumer looking at the respective marks as a whole. That analysis did not betray any error of principle, and a finding that essentially different concepts had been involved was one which was open (and indeed proper) on the evidence.
The second ground of appeal had nothing to do with the services to which the mark related and was no more than a re-running of the first ground of appeal.
Virgin Enterprises' submissions on the third ground of appeal were wrong, since the hearing officer had not actually treated conceptual similarity as the determinative criterion -- he hadn't regarded any factor as determinative. The weight to be given to each of the many factors relevant to his decision was pre-eminently a matter for him and could not be challenged on appeal.
The hearing officer did not not say that there could only be direct confusion where the marks were identical: he was expressly considering marks which were not identical and, deciding that the differences between the two was sufficiently great that there was no likelihood of confusion, he had adopted the correct legal approach.
As for the link, whether it existed between the two marks had to be assessed globally, taking into account all relevant factors and applying the principles of interdependence. This is a classic multi-factorial evaluation undertaken by a specialist tribunal, which an appellate court had to respect. In this case the hearing officer had not made any error in deciding whether 'the necessary link' had been established: he had not thought that the link had been to the proprietor (and not to the mark), and he had not thought that the link had to be economic. Further, based on the evidence before him, he was perfectly entitled to find that the necessary 'link' had not been proved: there being no link, there was no need to investigate the question whether Casey's mark would obtain any unfair advantage.

tytoc collie is delighted with this outcome, but saddened that Michael Casey should have been put to so much hardship and stress in his encounter with a giant company with a penchant for IP litigation. Naturally Virgin Enterprises is entitled to expect no lower level of IP protection than any other business -- but it doesn't own the word 'virgin' outright and it can expect others to use it in ways which neither confuse the public nor damage their own equity in the goodwill of their brands.

THE reported killing of the youngest son and three grandchildren of Libyan strongman Muammar Gaddafi in an air strike in Tripoli has fuelled a debate over the legitimacy of the NATO-led campaign.

The Libyan regime claimed the NATO missiles narrowly missed Colonel Gaddafi on Saturday night but killed four family members who had no ties to the government or military.

There was no independent confirmation of the deaths but the claims will complicate Western diplomacy and attempts to pressure Syria to stop its crackdown on protesters.

China, Russia and Turkey have already complained that NATO has exceeded its UN mandate to protect civilians. The West has been accused of backing the rebels to overthrow the regime.

Libyan officials said Colonel Gaddafi and his wife were at the Tripoli home of their son, Saif al-Arab, 29, during the attack, but were unharmed.

NATO confirmed it had staged air strikes in Tripoli, including on what it described as a command building in the Bab al-Aziziya neighbourhood, but declined to say if any Gaddafi family members were killed.

''All NATO's targets are military in nature,'' said Lieutenant-General Charles Bouchard, commander of mission to enforce a no-fly zone over Libya.

He said all targets had been linked to the regime's attacks on the civilian population. But regime spokesman Moussa Ibrahim condemned the strike as an attempt to assassinate the colonel, which he said was not permitted under international law or morally justifiable.

He said the family compound was in the Garghour neighbourhood. Reporters were taken to a house in an upmarket neighbourhood where one building was in ruins, with an unexploded missile in the rubble.

The regime has been notorious for staging journalist trips to sites it claims were struck by NATO, only for them to turn out to be concocted.

Another of Colonel Gaddafi's sons was reported killed earlier in the conflict but this was later proved to be incorrect.

Western officials have been divided over whether Colonel Gaddafi is a legitimate target under the UN resolution. US Defence Secretary Robert Gates said last week that NATO was ''not targeting Gaddafi specifically'' but that his command centres were legitimate targets.

But US officials rejected an assertion last month by British Defence Secretary Liam Fox that assassinating Colonel Gaddafi was ''potentially a possibility''.

Foreign Minister Kevin Rudd deflected the Libyan claim that Colonel Gaddafi had been targeted, a spokeswoman stating Australia regretted the loss of innocent civilians.

Saif al-Arab previously lived in Germany and had been suspected of arms smuggling. He was considered the least problematic of the Gaddafi family, with no ties to the government or military.

In a confidential March 2009 cable, released by WikiLeaks, US diplomats in Tripoli described him as a ''ne'er-do-well''.

Reports of his death sparked excitement among rebels in Benghazi who began an uprising against the regime more than two months ago. But there may have been confusion that Colonel Gaddafi's other son, Seif al-Islam, had been killed.

Earlier on Saturday, Colonel Gaddafi appeared both calm and defiant in a television speech, describing NATO's intervention as a ''massacre''.

Meanwhile, Britain is investigating reports that its embassy in Tripoli has been destroyed.

As Pope John Paul II has been idolized by the faithful Catholic followers of the world, there are major details intentionally overlooked in the mainstream media. Even if the information was disclosed, only a select group would understand its implications.Let's take a look at how this information could blow his beautification out of the water.

Darwin, Pierre Tielhard de Chardin, and Pope John Paul II

Through the ministry of Pierre Tielhard de Chardin, his false scientific study did much to cast doubt on Biblical Christianity. He was one of the key individuals promoting Darwin's Theory of Evolution, and was at the ground floor of being accepted by the Catholic church. This Jesuit priest was involved in many missing links cases around the world, all based on false scientific proof. Teilhard ran into serious problems with the Roman Catholic Church, because of his unorthodox beliefs. He was censored by the Church, and he could no longer teach or publish his theological and philosophical views. He was even 'exiled' from France by the Jesuit order.

Tielhard became the hero of some elite Protestants. Then on October 23, 1996, Pope John Paul II issued a statement to the Pontifical Academy of Sciences in which he endorsed evolution as being "more than just a theory" and claims about the origin of this universe and the appearance of life forms on Earth.[2]

The Church that once rejected evolutionary thinking, accepted its hypothesis - largely do to the Pope. His acceptance, consequently, caused Pope John Paul II to create code changes to the Vatican II constitution in 1983, which would enhance ecumenical outreach.[3] It launched a movement that would go hand-in-hand with his plan to create a universal faith.

Chris Pinto goes on to explain that Ecumenism plays a key role in the pagan religions of the world, and are largely based on its unity precepts. These pagan beliefs fit nicely in with the New Age movement, since they also long for the world to be at peace as one. Many New Agers claim that Pierre Tielhard de Chardin did more to influence them than any other figure, and he has become known as the Father of the New Age Movement. It was his desire to bring about final spiritual unity, and reconstruct the Christian faith.
