Last January we informed you about the motion he had submitted Microsoft to the Office U.S. Patent and Trademark Office requesting that refused it to Apple 's award of the name "App Store" as a trademark , arguing that it was too generic a term that was used to refer to all mobile application stores and not just to the apple company.

Apple's response could not be expecting too much more and have taken to remind them why a word like Windows can be registered as a trademark within a certain context. "Microsoft is unable to see the forest for the trees" , shamelessly says the document listed the names of the different stores applications from companies such as Nokia, Palm, BlackBerry or Microsoft itself as evidence of anything specific and generic nature of the term "App Store".

Now it's up to the Office U.S. Patent and Trademark consider the case and determine if the motion of Microsoft have enough weight or else let the trademark go through the hearing for a final resolution in which it is granted (or not ) to Apple.
